New Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) Laws

From 1 July 2026, new anti-money laundering (AML) checks apply when you buy or sell property in Queensland.

Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) laws will apply to real estate agencies across Australia. These reforms introduce legal requirements for agencies to verify the identity of clients and carry out additional due diligence before providing certain real estate services.

While these requirements may be new to the property sector, similar verification processes have long been standard practice within banking, finance, and legal services.

What it means for you as a property owner or buyer

If you’re selling or buying property through an agency, you may be asked to provide:

  • Photo identification (passport, driver’s licence, etc.)
  • Proof of residential address (rates notice, electricity or water bill)
  • Information about companies, trusts, SMSFs, or other entities involved
  • Details about the people who ultimately own or control those entities (“beneficial owners”)
  • If you are a buyer, be ready to explain, in a sentence, where your funds are coming from. A simple explanation – savings, the sale of another property, a gift or inheritance – is usually all that’s needed.

Please Note – If you can’t or won’t provide the required identity or source-of-funds information, your conveyancer or agent may be legally prevented from acting for you. It’s a legal obligation, not their discretion.

Where a property is owned or purchased through a company, trust, or similar entity, agencies must also identify the individuals who ultimately own or control that entity.

Why are these changes being introduced?

The reforms are designed to help prevent money laundering, fraud, terrorism financing and other forms of financial crime. Real estate has now been included within Australia’s broader regulatory framework to help safeguard property transactions from misuse.
